Myunmelt Commission
Terms of Service

Commissions are all digital goods, unless otherwise agreed in the Commission Agreement. Nothing is ever intended by either me or the Client, to be physically shipped to them.

Completed work is delivered electronically via email in .PNG format; this does not include the Commission native files (e.g., .clip, .psd, .ai), unless agreed upon in the Commission Agreement, or thereafter, the Client obtains written permission from the Artist.

The Artist does not provide any service for AI, NFT, racist, or hateful purposes.

The display size of the Commission is set at a default maximum resolution of 2480 x 3508 pixels at 300 dpi (RGB color mode). Custom display settings for the Commission are available upon request. A larger display size will incur additional illustration fees, to be defined and agreed upon in the Commission Agreement prior to the Start of Work.

All prices are provided as a guide only and may not represent the final price of a particular Commission.

Commissions for commercial purposes will incur additional fees, to be defined and agreed upon in the Commission Agreement prior to the Start of Work.

A complex Commission will incur additional illustration fees, to be defined and agreed upon in the Commission Agreement prior to the Start of Work.

Original works on the Artist’s website, or at any links associated with this site, and commissions authored by Myunmelt are registered and protected under the Copyright Act and may not be used without the explicit written permission of the artist.

The Artist retains all rights to the commission, which include but are not limited to: Distribution, reproduction, use of the Commission for Artist promotion (e.g., profiles, personal space, public space, as defined in the Definitions section herein, etc.); or as it applies to new Terms of Service agreed upon in a "Transfer of Copyright Agreement" as defined in the Client Documents.

A nondisclosure agreement (NDA) can be requested by the Client. NDA will incur additional fees, to be defined and agreed upon in the Commission Agreement prior to the Start of Work.

The Artist will not reproduce a Copyrighted or Trademarked image or character without the express written permission of the Copyright or Trademark owner. This applies to Fan Art commissions of Copyrighted or Trademarked characters for which paid Fan Art is not permitted.

The Artist reserves all reproduction rights, including the right to claim statutory copyright, on all works.

Sale, publication, or reproduction in any manner is strictly prohibited without the prior express, written consent of the Artist. Publication also encompasses social media, including but not limited to Facebook, Instagram, and any other similar platforms.

The Client may not distribute, reproduce, or otherwise profit from the Commission beyond the new Terms of Service agreed upon in a Commercial Purpose Commission Agreement as defined in the Definitions section herein.

The Client may not edit, alter, or trace the Commission without the Artist’s expressed, written permission or as agreed upon in the Commission Agreement prior to the Start of Work.

The Client is granted permission to display the commission in Profiles as long as the Artist’s name (“Myunmelt”) is prominently displayed.

Distributing any Commission from the Artist to the NFT or AI site community is strictly prohibited.

If the Client wishes to order a commission for Commercial use, the total price of the Commission, as well as any other royalties, will be agreed upon upfront.

The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately; cases where the Client receives profit from a medium or platform where they have posted the artwork (e.g., Patreon, YouTube, Twitch, a personal site, business cards, etc.).

The Client is required to provide details on how the commissioned piece will be used every time.

The minimum price increases by 50% of the original price, meaning double the end sum. However, the Artist reserves the right to charge more if they deem it fit.

The Client must specify the content of the Commission to the best of their ability. The Client is responsible for providing important information and a clear description / reference to the Artist prior to a Commission Agreement. Failing to provide information may result in the Artist’s inability to complete the Commission to the Client’s fullest satisfaction, in which the Client will be held responsible.

The Client is obligated to respond to the Artist in a timely fashion. The Artist will not be held responsible for late delivery due to the Client’s negligence of communication. Absence of communication longer than three consecutive months will be considered as cancellation with no refund.

If the Client wish for the Commission request to be private, it must be stated during the ordering process, and the Artist reserve the right to charge a fee if the Artist deem it fit.

Commission offers that satisfy the following components are given higher priority than other offers: the Artist's skill level, availability, flexibility of deadlines, and subject matter.

The Artist has the right to refuse any Commission request without needing to explain the reason.

Full payment must be made at the signing of the Commission Agreement prior to the Start of Work, or alternatively, a 50% up-front deposit can be paid to reserve a Commission queue.

Payment methods are determined as written in the Commission Agreement prior to the Start of Work. The Artist’s preferred methods of payment are via Bank Direct Payment, PromptPay, Arbum’s built-in service, and Buy Me a Coffee. Additional payment methods can be made available to the Client upon request.

In the event that payment is made in installments (i.e., a 50% deposit), ownership of the Commission will only pass from the Artist to the Client on receipt of payment in full. The Commission will not be sent to the Client until the agreed payment amount has been received. Any further work on the Commission will be withheld until the agreement is made and payment is received.

Revisions are categorized as major and minor revisions, in which each category has its limits and timing. It is up to the Artist’s discretion as to what constitutes minor and major revisions.

The timing and amount of takes in which the Client is allowed revision is to be defined and agreed prior to a Commission Agreement. Extra revision will incur additional fees, also to be defined and agreed upon in the Commission Agreement prior to Start of Work.

Revisions due to the Artist’s negligence are free of charge.

If the Commission is time-sensitive, a rush fee may be applied, to be defined and agreed upon in the Commission Agreement prior to the Start of Work.

Each commission is unique and custom-drawn; therefore, time frames for completion will vary. The Artist works on a regular turnaround of 30 to 90 days, unless stated otherwise in the Commission Agreement.

The Artist must give a general indication of how long the Commission will take to complete and when the Client can expect to receive the finished illustration prior to the Start of Work.

The Artist will inform the Client of progress—including a WIP (‘work in progress’) image—or if changes to completion times have occurred. The Artist is not obliged to explain the reasoning behind extensions or delays in the completion of a Commission.

Delivery of complete work is submitted through an online download location (e.g., Google Drive or Arbum’s built-in service) for a finite period of time. The Client is obliged to download and store a copy of the delivered work before the download location expires.

The Artist reserves the right to stop work on a Commission, or cancel a Commission request due to poor communication, rude or inappropriate behavior, an inability to effectively communicate in English or Thai, or a breach of these Terms of Service. The Artist also reserves the right to stop or cancel work in the event of an emergency, accident, or illness.

The Client may cancel the Commission only prior to Start of Work.

A full refund can be issued if the Client cancels the Artist prior to the Start of Work (the status column on the artist's commission queue hasn't changed to 'Sketching').

Refunds, as well as unauthorized chargebacks, are not allowed after the Start of Work, or if any of these Terms of Service are breached during any period of the commission.

Disliking the Commission or having a change of mind is not considered for a refund.

A full refund will be issued in the event that the Artist must cancel work due to sudden unavailability or an emergency.

ผลงานที่ถูกสร้างสรรค์เสร็จเรียบร้อยแล้วจะถูกส่งไปยังอีเมลของผู้ว่าจ้างในรูปแบบของไฟล์ .PNG ไม่รวมไฟล์ต้นฉบับ (เช่น .clip, .psd) เว้นแต่จะมีการตกลงหรือบอกแจ้งระหว่างผู้ว่าจ้างกับผู้วาด

ทางผู้วาดไม่อนุญาตให้นำผลงานไปใช้ในวัตถุประสงค์เกี่ยวข้องกับ AI หรือนำไปอัปโหลดลงเว็บไซต์ที่เกี่ยวข้อง รวมทั้งไม่อนุญาตให้นำภาพไปใช้กับ NFT / การเหยียดชนชั้น หรือวัตถุประสงค์ที่สร้างความเกลียดชังโดยเด็ดขาด

ขนาดไฟล์ใหญ่สุดของคอมมิชชั่นโดยทั่วไปจะอยู่ที่ 2480 x 3508 pixels, 300 dpi (โหมดสี RGB) สามารถแจ้งขนาดที่ต้องการได้ ทั้งนี้จะมีค่าใช้จ่ายเพิ่มเติมสำหรับขนาดไฟล์ที่ใหญ่กว่าที่ตั้งเอาไว้ โดยการจัดแจงราคาและการเจรจาตกลงจะเกิดขึ้นก่อนเริ่มงาน

ผู้วาดถือสิทธิ์ทั้งหมดในผลงานคอมมิชชั่น ซึ่งรวมถึงแต่ไม่จำกัดเพียงการเผยแพร่ การทำซ้ำ หรือการใช้ภาพเพื่อการโปรโมทตัวผู้วาด (เช่น โปรไฟล์ พื้นที่ส่วนตัว พื้นที่สาธารณะ) หรือเป็นไปตามข้อกำหนดการให้บริการใหม่ที่อาจมีการตกลงไว้ในเอกสารการโอนสิทธิ์ของทางผู้ว่าจ้าง

ผู้ว่าจ้างสามารถเสนอสัญญารักษาความลับ (NDA) ได้ โดยการจัดแจงราคาและการเจรจาตกลงจะเกิดขึ้นก่อนเริ่มงาน

ผู้วาดจะไม่ทำซ้ำภาพหรือตัวละครที่มีลิขสิทธิ์หรือเครื่องหมายการค้าโดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรชัดเจนจากเจ้าของลิขสิทธิ์หรือเครื่องหมายการค้านั้น ๆ ซึ่งข้อตกลงนี้มีผลใช้กับแฟนด้อมที่ไม่อนุญาตให้ทำการคอมมิชชั่นภาพแฟนอาร์ต

ผู้วาดขอสงวนสิทธิ์ในการทำซ้ำทั้งหมด รวมถึงสิทธิ์ในการเรียกร้องลิขสิทธิ์ตามกฎหมายในทุกผลงาน

ห้ามมิให้จำหน่าย เผยแพร่ หรือทำซ้ำไม่ว่าจะในลักษณะใดโดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษรล่วงหน้าจากทางผู้วาด การเผยแพร่ในที่นี้ครอบคลุมถึงโซเชียลมีเดีย ซึ่งรวมถึงแต่ไม่จำกัดเพียงเฟซบุ๊ก อินสตาแกรม และแพลตฟอร์มอื่นใดก็ตาม

ผู้ว่าจ้างไม่สามารถแจกจ่าย ทำซ้ำ หรือหากำไรจากคอมมิชชั่นนอกเหนือจากข้อกำหนดในการให้บริการที่ตกลงไว้

ผู้ว่าจ้างไม่สามารถแก้ไข เปลี่ยนแปลง หรือลอกแบบคอมมิชชั่นโดยไม่ได้รับอนุญาตจากทางผู้วาดเป็นลายลักษณ์อักษร

ผู้ว่าจ้างสามารถนำผลงานที่จ้างไปโพสต์ลงหรือตั้งประดับโปรไฟล์ส่วนตัวได้ ตราบใดที่มีการให้เครดิตกลับมาทางผู้วาด (“Myunmelt”)

ห้ามแจกจ่ายชิ้นงานของทางผู้วาดลงชุมชนหรือเว็บไซต์ที่เกี่ยวข้องกับ NFT หรือ AI โดยเด็ดขาด

หากผู้ว่าจ้างต้องการนำงานผลงานไปใช้ในเชิงพาณิชย์ ราคารวมของชิ้นงานคอมมิชชั่นรวมถึงค่าลิขสิทธิ์อื่น ๆ จะต้องได้รับการตกลงระหว่างผู้วาดและผู้ว่าจ้างล่วงหน้า

การนำผลงานไปใช้งานดังต่อไปนี้ถือว่าเป็นการนำไปใช้เชิงพาณิชย์: ผลิตและทำการค้าขายไม่ว่าจะในที่สาธารณะหรือเป็นการส่วนตัว รวมไปถึงการใช้ประชาสัมพันธ์เพื่อก่อให้เกิดรายได้ผ่านสื่อหรือแพลตฟอร์ม (เช่น พาทรีออน ยูทูบ ทวิทช์ เว็บไซต์ส่วนตัว ใบราคาสินค้า เนมการ์ด ฯลฯ)

ผู้ว่าจ้างจำเป็นต้องระบุรายละเอียดเกี่ยวกับการนำชิ้นงานคอมมิชชั่นไปใช้ทุกครั้ง

ราคาขั้นต่ำของการนำไปใช้เชิงพาณิชย์ อยู่ที่ 50% ของราคาดั้งเดิม ทั้งนี้ทางผู้วาดมีสิทธิ์ในการปรับเพิ่มราคาดังกล่าวตามเห็นสมควรขึ้นอยู่กับวัตถุประสงค์การนำไปใช้งาน

ผู้ว่าจ้างจำเป็นต้องระบุรายละเอียดคอมมิชชั่นให้ครบถ้วน ไม่ว่าจะเป็นการให้ข้อมูลสำคัญ ข้อความอธิบายหรือภาพอ้างอิงที่ชัดเจน การไม่ให้ข้อมูลอาจส่งผลให้ทางผู้วาดไม่สามารถทำภาพวาดออกมาได้ตามความพึงพอใจ ซึ่งนับเป็นความรับผิดชอบของทางตัวผู้ว่าจ้างเอง

ผู้ว่าจ้างจำเป็นต้องตอบกลับทางผู้วาดภายในเวลาที่เหมาะสม ความล่าช้าในการทำคอมมิชชั่นจากปัญหาทางการสื่อสารของผู้ว่าจ้างไม่ถือเป็นความรับผิดชอบของผู้วาด การขาดติดต่อสื่อสารนานกว่าสามเดือนติดต่อกันจะถือเป็นการยกเลิกงานโดยไม่มีการคืนเงิน

หากผู้ว่าจ้างต้องการให้ไม่เปิดเผยภาพคอมมิชชั่น ทางผู้ว่าจ้างจำเป็นต้องระบุแจ้งในขั้นตอนการส่งรายละเอียดบรีฟงาน โดยทางผู้วาดขอสงวนสิทธิ์ในการเรียกค่าใช้จ่ายเพิ่มเติมตามเห็นว่าเหมาะสม

ข้อเสนอคอมมิชชั่นที่เป็นไปตามองค์ประกอบต่อไปนี้จะได้รับลำดับความสำคัญสูงขึ้น: ระดับทักษะของผู้วาด ความพร้อม ความยืดหยุ่นของกำหนดเวลา และหัวข้อหรือรายละเอียดของบรีฟงาน

ผู้วาดมีสิทธิ์ปฏิเสธคำขอคอมมิชชั่นใด ๆ โดยไม่ต้องแจงเหตุผลให้ทราบ

ผู้ว่าจ้างจะต้องชำระเงินเต็มจำนวนก่อนเริ่มงาน หรือชำระเงินมัดจำล่วงหน้า 50% เพื่อจองคิวคอมมิชชั่น

วิธีการชำระเงินจะถูกแจ้งไว้ในข้อตกลงคอมมิชชั่น โดยช่องทางที่สะดวกของทางผู้วาดได้แก่การชำระเงินผ่านธนาคารโดยตรง / PromptPay / VGen / Arbum / Buy Me a Coffee และ Ko-fi

ในกรณีที่ชำระเงินเป็นงวด (เช่น มัดจำ 50%) ความเป็นเจ้าของของผลงานคอมมิชชั่นนั้นจะเป็นของผู้ว่าจ้างต่อเมื่อมีการชำระเงินเต็มจำนวนแล้วเท่านั้น จะไม่มีการส่งภาพคอมมิชชั่นที่เสร็จสมบูรณ์หรือดำเนินงานใดต่อจนกว่าจะได้รับจำนวนเงินตามที่มีการตกลงกันไว้

การแก้ไขแบ่งประเภทออกเป็นการแก้ไขจำนวนมากและเล็กน้อย ซึ่งแต่ละประเภทมีข้อจำกัดและระยะเวลาในการแก้ไขเกี่ยวข้อง ขึ้นอยู่กับดุลยพินิจของทางผู้วาดว่าสิ่งใดเป็นการแก้ไขเล็กน้อย (จุดเล็ก, ไม่กระทบภาพรวม) และสิ่งใดเป็นการแก้ไขจำนวนมาก (จุดสำคัญ, กระทบภาพรวม)

จำนวนครั้งที่ผู้ว่าจ้างสามารถแจ้งให้ผู้วาดแก้ไขได้จะมีการกำหนดและตกลงก่อนล่วงหน้าในรายละเอียดคอมมิชชั่นที่เปิดรับ หากมีการขอแก้ไขมากกว่าที่ตั้งเอาไว้จะมีค่าใช้จ่ายเพิ่มเติม โดยการจัดแจงราคาและการเจรจาตกลงจะเกิดขึ้นก่อนทำการแก้ไขงาน

ไม่มีค่าใช้จ่ายในการขอแก้ไข กรณีความผิดพลาดเกิดจากการละเลยหรือตกหล่นของทางผู้วาด

หากมีการกำหนดเวลาที่ชัดเจนสำหรับชิ้นงานคอมมิชชั่น อาจมีค่าใช้จ่ายในการเร่งงานเพิ่มเติม โดยการจัดแจงราคาและการเจรจาตกลงจะเกิดขึ้นก่อนเริ่มงาน

งานคอมมิชชั่นแต่ละชิ้น เป็นงานที่ถูกสร้างสรรค์ขึ้นมาใหม่และตามสั่ง ดังนั้นระยะเวลาที่ใช้ในการทำให้เสร็จจะแตกต่างกันไป เวลาในการทำผลงานจะอยู่ที่ 30-90 วัน เว้นแต่จะระบุไว้เป็นอย่างอื่นในข้อตกลงคอมมิชชั่น

ผู้วาดจะต้องให้รายละเอียดโดยคร่าวก่อนเริ่มงานว่าจะใช้เวลาเท่าใดในการทำภาพคอมมิชชั่นและเมื่อใดที่ทางผู้ว่าจ้างจะได้รับภาพผลงานที่เสร็จสมบูรณ์

ผู้วาดจะแจ้งให้ทางผู้ว่าจ้างทราบถึงความคืบหน้าหรือหากมีการเปลี่ยนแปลงเวลาในการทำคอมมิชชั่นให้เสร็จ โดยทางผู้วาดไม่จำเป็นต้องแจงเหตุผลให้ทราบ

ผู้ว่าจ้างมีหน้าที่ในการดาวน์โหลดและจัดเก็บสำเนาของผลงานคอมมิชชั่นที่ทางผู้วาดส่งให้

ทางผู้วาดขอสงวนสิทธิ์ในการหยุดทำคอมมิชชั่นหรือยกเลิกงาน หากพบว่าผู้ว่าจ้างมีพฤติกรรมไม่เหมาะสม หยาบคาย การสื่อสารไม่ดีหรือไม่สามารถติดต่อได้ หรือฝ่าฝืนข้อกำหนดในการให้บริการ นอกเหนือจากนี้ทางผู้วาดขอสงวนสิทธิ์ในการหยุดหรือยกเลิกงานในกรณีฉุกเฉิน เกิดอุบัติเหตุหรือการเจ็บป่วยอันทำให้ไม่สามารถทำงานต่อได้

ผู้ว่าจ้างสามารถยกเลิกคอมมิชชั่นก่อนทางผู้วาดเริ่มงานเท่านั้น

ผู้ว่าจ้างสามารถขอคืนเงินเต็มจำนวนได้หากผู้วาดยังไม่ได้เริ่มงาน (ยังไม่ขึ้นว่า Sketching ในตารางคิว)

ไม่มีการคืนเงินในกรณีที่ต้องการปฏิเสธการชำระเงินหรือเรียกเงินคืนหลังทำการเริ่มงานแล้ว

การไม่ชอบผลงานคอมมิชชั่นที่ได้รับหรือเปลี่ยนใจไม่รับชิ้นงาน ไม่รวมอยู่ในเงื่อนไขการคืนเงิน

จะมีการคืนเงินเต็มจำนวนในกรณีที่ผู้วาดจำเป็นต้องยกเลิกงานเนื่องจากความไม่พร้อมกะทันหันหรือเกิดเหตุให้ไม่สามารถทำงานต่อให้ได้

Artist: The individual producing the Commission ("Myunmelt").

Client: The individual or organization purchasing the Commission.

Commission: The form of service provided by the Artist to the Client per the Commission Agreement. "Commission," "Art[work]," “Image[ry],” and “Project[s]” are used interchangeably herein and in Commission correspondence.

Commission Agreement: The discussion, documented via online message system or email (or where email is not available, via Thai Postal Service), in which the Artist and Client agree to the subject matter and type of Commission to be produced, the Commission price, the point in time in which the Artist is expected to commence in the Start of Work, and—if applicable—the Commission deadline, early termination circumstances, rush fees, Transfer of Copyright, and/or whether or not the Commission can be immediately displayed in the Artist’s portfolio. This Commission Agreement shall remain on record with the Artist, along with any other documents related to the Commission, for at least two years.

Start of Work: The point in time by which the Client has approved the Artist to start work on the Commission (e.g., the artist begins to create the Commission).

Profile(s): Online locations where the Commission may be displayed (e.g., "galleries," such as myunmelt.carrd.co, Facebook, Instagram, and Twitter albums, DeviantART.com, etc.). "Profile(s)" do not include any sites that display hateful or racist imagery, illegal activities, or sites known to display, reproduce, and/or sell works without crediting the Artist. Additionally, no Commission may be displayed without notifying the Artist first or as agreed upon in the Commission Agreement.

Personal Space: Non-public, offline locations (e.g., home or office); i.e., no business involving the Commission is being conducted.

Public Space: Offline locations that do not fall under "Personal Space" above.

Commercial Purpose: Any image or project to be commissioned that does not fall under the type of use specified in these Terms of Service shall be developed and agreed upon in a Commercial Purpose Commission Agreement prior to the Start of Work.

Commercial Purpose Commission Agreement: A Commission Agreement developed specifically for Commercial Purpose Commissions A Commercial Purpose Commission Agreement requires separate Terms of Service, developed on a case-by-case basis.

Transfer of Copyright Agreement: The discussion, documented via online message system or email (or, where email is not available, via Postal Service), in which the Artist and Client agree to transfer the Copyright of the Commission from the Artist to the Client. This does not include Trademarks.
